1. Overview

Welcome to Mike Keefe Photography. These Terms of Service govern your use of mikekeefephotography.com and purchases made through this website. “We,” “us,” and “our” refer to Mike Keefe Photography.

Please review these terms before placing an order. Our Refunds and Returns Policy, Shipping Policy, and Privacy Policy provide additional information about shopping with us.

Our online store is hosted by Shopify, which provides the ecommerce platform used to offer our products.

2. Using Our Website

You may use this website only for lawful purposes. You must not interfere with its operation, attempt to access restricted systems, submit fraudulent orders, or infringe the rights of others.

When placing an order, you confirm that you are legally able to make the purchase and authorized to use the payment method provided. You agree to supply accurate contact, billing, and shipping information.

3. Products and Images

We sell original photography prints in the sizes and materials described on individual product pages. Prints are produced and shipped through fulfillment partners.

We make reasonable efforts to represent our products accurately. Screen settings, lighting, and printing materials can affect how colors appear. Different print dimensions may require different crops.

Room mockups illustrate possible display settings. Furniture, frames, mats, and other accessories are not included unless expressly stated in the selected product option. Mockups should not be used to determine a print’s physical size.

These display considerations do not excuse a defective, incorrect, or materially misrepresented product.

4. Prices and Payments

Prices and the currency used are displayed on the website. Applicable taxes and shipping charges, if any, are shown at checkout.

Payment is required before an order enters production. Prices and availability may change for future purchases.

If we discover a material pricing, description, or availability error affecting your order, we will contact you to explain the issue. We will not charge an additional amount or substitute a different product without your agreement. If we cannot fulfill the order as agreed, we will cancel it and refund the amount paid for the canceled items.

5. Order Changes and Cancellations

Please check your photograph, material, dimensions, quantity, and shipping address before completing checkout.

Once your order has been submitted to our fulfillment partner, we cannot accommodate voluntary changes or cancellations. If you notice an error, contact us immediately. We will help when possible before submission, but we cannot guarantee a change or cancellation.

This restriction does not affect cancellation or refund rights required by law, including rights that may apply when we cannot ship within the required time.

We may decline or cancel an order when we reasonably suspect fraud, cannot obtain payment authorization, or cannot fulfill the purchase. If we cancel a paid order, we will refund the canceled portion.

6. Production and Shipping

Production and shipping information is provided on the applicable product page, at checkout, or in our Shipping Policy. Production time is separate from carrier transit time unless stated otherwise.

If we cannot ship within the promised or legally required period, we will notify you and provide any delay, cancellation, and refund options required by law.

Please contact us if an order is lost, arrives damaged, or does not arrive as expected. We will work with you and our fulfillment partner to investigate and resolve the issue.

Customers are responsible for providing an accurate shipping address. If an address error causes a return or requires reshipment, we will explain any proposed additional costs before proceeding.

7. Returns, Exchanges, and Satisfaction

We do not accept returns or exchanges for changes of mind, incorrect customer selections, or material preferences, except where required by law.

We are committed to your 100% satisfaction with the quality and condition of your print. If your order arrives with a printing defect, shipping damage, or an incorrect item, please contact us promptly with your order number and a description of the problem. Clear photographs of the print and packaging help us resolve the issue.

We will work with you to provide a replacement, refund, or another appropriate solution. You will not be responsible for the cost of correcting a confirmed defect, shipping damage, or our fulfillment error.

Our satisfaction commitment does not create a general change-of-mind return right. Please review our Refunds and Returns Policy for further details. Nothing in either policy limits your statutory consumer rights.

8. Copyright and Permitted Use

The photographs and original content on this website are protected by copyright. Purchasing a physical print transfers ownership of that physical item, but does not transfer copyright or reproduction rights.

You may display your purchased print in your home, office, or other space. Unless a separate license or applicable law permits it, you may not scan, reproduce, distribute copies of, or use the photograph to create merchandise or advertising without prior written permission.

Any digital product is subject to the license stated on its product page or accompanying materials. Please contact us about licensing or other uses.

9. Privacy and Service Providers

Our Privacy Policy explains how personal information is collected, used, and shared in connection with the store.

We use Shopify and other service providers to support payments, production, shipping, and store operations. Their involvement does not remove our responsibilities to you as the seller.

Third-party websites linked from our store operate under their own terms and privacy practices.

10. Website Availability and Responsibility

We aim to keep the website accurate and available, but temporary interruptions and errors may occur. Please contact us if you encounter a problem that affects your order.

Nothing in these terms excludes any warranty, remedy, or responsibility that cannot lawfully be excluded. Our commitments concerning defective products, incorrect orders, and shipping damage remain in effect.

11. Governing Law and Disputes

To the extent permitted by applicable law, these terms are governed by the laws of New Hampshire and applicable United States federal law.

This provision does not deprive you of mandatory consumer protections that apply where you live.

If you have a concern, please contact us so we can try to resolve it. These terms do not require arbitration or waive any right to pursue remedies available under applicable law.

12. Changes to These Terms

We may update these terms by posting a revised version with a new “Last updated” date. Changes will apply prospectively and will not retroactively reduce your rights concerning an existing order.
